DESCRIPTION/ENTRY PERIOD: Entry into the Back to School Giveaway “(the “Giveaway”) begins at 12:00:00 am Pacific Time (“PDT”) on September 3, 2025, and ends at 11:59:59 pm PDT on Sunday, September 14, 2025 (the “Promotion Period”). Two grand prize winners will be chosen at random to win 1) a set of Apple AirPods Pro 2 Wireless Earbuds (MTJV3LL/A & BA0B3LL/A) (including AppleCare+ for Headphones for two (2) years) and 2) one (1) NeilMed Kyrosol All-Natural Earwax Removal Aid. Prizes will be awarded to the two (2) grand prize winners on September 15, 2025. Twenty-five (25) additional winners will be selected at random to receive one NeilMed Kyrosol All-Natural Earwax Removal Aid prize. Entry in the Giveaway does not constitute entry into any other promotion, contest or Giveaway. By participating in the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of NeilMed Pharmaceuticals, Inc. 601 Aviation Blvd, Santa Rosa CA 95403. (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: The Giveaway is open to residents of the 50 United States and the District of Columbia who are eighteen (18) years of age or older at time of entry. Employees, officers and directors (and each of the direct family and/or individuals residing in the households of each, whether or not related) of the Sponsor are not eligible to participate. The Giveaway is void outside the United States and where prohibited by law.
HOW TO ENTER: To enter, go to the Squip Instagram page (https://www.instagram.com/squipusa/) anytime during the promotion period. Become a fan of the Squip Instagram page by clicking the “Follow” button. Click on the pinned “Back to School Giveaway” post and then like and comment on the post. Then share the post on your Instagram story using the hashtag #SquipGiveaway to disclose participation. By following the Squip Instagram page, liking and commenting on the Giveaway post and then sharing the post on your story with disclosure, the participant will receive one (1) entry into the drawing (the “Drawing”). Entries will remain in the pool for the duration of the promotion and will have a chance to win on the last day. LIMIT: one (1) entry per household per Instagram account. Each entry will be deemed to have been submitted by the record holder of the Instagram account associated with the entry. If Sponsor determines (in its sole discretion) that any person entered or attempted to enter the Giveaway more than one time, all his/her entries may be declared null and void. The Sponsor’s computer/server is the official timekeeping device for this Giveaway. No automated entry devices and/or programs permitted. Entries generated by a script, macro or other automated means will be disqualified. Each participant must be the rightful owner of the Instagram account used to access the Promotion. Participants must provide all the information requested to be eligible to enter. Incomplete, unreadable, or unintelligible entries will be disqualified. Entries will not be returned or acknowledged by the Sponsor.
PUBLICITY RELEASE: By participating in the Giveaway, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any participant in or winner of the Giveaway, each participant irrevocably grants the Sponsor and its successors, assigns and licensees, the right to use such participant’s name, likeness, and biographical information in any and all media for any purpose, including without limitation, advertising and/or promotional purposes, without additional compensation where permitted by law, and hereby releases the Sponsor from any liability with respect thereto.
PRIVACY AND CONSENT TO MARKETING: By entering this giveaway, you consent to the collection, use, and storage of your personal information by NeilMed for the purpose of administering the giveaway and contacting winners. Your personal information will be handled in accordance with our Privacy Policy, available at https://www.neilmed.com/usa/privacy-policy/.
WINNER SELECTION, NOTIFICATION AND VERIFICATION: There will be two (2) Grand Prize winners and twenty-five (25) second place winners. The winners will be randomly selected on the last day from all eligible entries received during the Promotion Period by representatives of the Sponsor, whose decisions are final. The winners will be chosen on September 15 and notified via direct message. If, despite reasonable efforts, a potential winner does not respond within seventy-two (72) hours of Sponsor’s first notification attempt, if the notification is returned as undeliverable, or if the Sponsor determines (in its sole discretion) that any potential winner has not complied with these Official Rules, such potential winner will forfeit his/her prize and an alternate winner may be selected in Sponsor’s sole discretion.
PRIZES: On September 15, 2025, each of the two (2) grand prize winners will receive one (1) set of Apple AirPods Pro 2 Wireless Earbuds (Model MTJV3LL/A & BA0B3LL/A), with AppleCare+ for Headphones for two (2) years, retail value USD $279; and one (1) NeilMed Kyrosol All-Natural Earwax Removal Aid (SKU: US901-ENU-US), retail value USD $9.95. One (1) new NeilMed Kyrosol All-Natural Earwax Removal Aid (SKU: US901-ENU-US), retail value USD $9.95, will be awarded to the next twenty-five (25) winners randomly selected. All prizes will be in their original packaging from the manufacturer and will be delivered to the address provided by the contestant at no cost to the winners. Winners are responsible for any and all applicable federal, state, and local taxes. Where applicable, Sponsor may issue IRS Form 1099 for prizes exceeding $600.
GENERAL: The Giveaway is void outside the United States and where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. By submitting an entry, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the Sponsor and/or its representatives, and warrants that he/she is eligible to participate in this Giveaway. By participating in this Giveaway, each entrant agrees that the Sponsor (a) shall not be responsible or liable for and releases the Sponsor for any losses, damages or injuries of any kind resulting from participation in the Giveaway or any Giveaway-related activity, or from participant’s acceptance, receipt, possession and/or use or misuse of the prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to a participant’s computer system resulting from or in any way connected to participation in this Giveaway, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, omissions, failures, deletions, defects, delays, delayed computer transmissions or network connections that are human or technical in nature. Sponsor disclaims any and all liability for: late, lost, damaged, postage due, stolen, incorrect, misdirected, misplaced, garbled, misaddressed entries or communications lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites or other connections; miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; any technical malfunctions, failures, difficulties or other errors of any kind or nature; the incorrect or inaccurate capture of information; and/or the failure to capture any information in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor reserves the right in its sole discretion to disqualify any individual who it determines is tampering with the entry process or the operation of the Giveaway, acting in violation of these Official Rules, or if his/her fraud or misconduct affects the integrity of the Giveaway. In the event Sponsor is prevented from operating the Giveaway or awarding the prizes as contemplated herein, Sponsor shall have the right to modify, cancel, suspend, or terminate the Giveaway. In the event of any such cancellation, termination or suspension, a notice will be posted, and a random drawing will be conducted from among all eligible, non-suspect entries received prior to such time. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW / DISPUTES: This Giveaway will be governed by the laws of the State of California. By entering, participants agree that any dispute, claim, or cause of action arising out of or relating to this Giveaway shall be resolved by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules. All proceedings will take place in Santa Rosa, California. Participants waive the right to bring claims in court (except for small claims matters) and waive the right to participate in a class action or representative proceeding.
